Terms and conditions

These are the terms you agree to when you order a portrait from us. They are written to be read rather than to be got past, and nothing in them takes away your rights as a consumer.

The one to read twice

If you do not respond to your proof within 48 hours, we print it.

We do that so your order arrives on time, and we send a reminder first. Ask for a change or cancel any time before the deadline and nothing is printed.

Who you are dealing with

Likeness Editions is a trading name of You&I Marketing Ltd, a company registered in England and Wales under company number 15372419, with its registered office at Unit 7, Olympic Way, Warrington, WA2 0YL.

Your contract is with You&I Marketing Ltd. You can reach us at hello@likenesseditions.co.uk and we answer every message ourselves.

These terms

These terms apply to everything you buy from likenesseditions.co.uk. By placing an order you accept them, so please read them first.

Nothing here takes away the rights the law gives you as a consumer. Where a term below appears to conflict with those rights, your rights win.

We may update these terms. The version that applies to your order is the one published when you placed it, which is why the date at the top matters.

Placing an order

When you check out you are making us an offer. The contract between us begins when we email you to confirm we have accepted it, not when you pay.

We may decline an order. The usual reasons are that the photograph cannot be worked from, that we cannot lawfully make what has been asked for, or that we have made a pricing error. If we decline, you are refunded in full straight away and we owe you nothing further.

The photograph you send us

Everything we make starts with a photograph you upload, so a few things have to be true about it. When you place an order you are confirming that:

  • It is yours to use you either took it, own it, or have permission from whoever does.
  • Everyone in it is content to be there including anyone who is not you, and a parent or guardian where a child is pictured.
  • It is lawful not obscene, not hateful, and not depicting anyone in a way they have not agreed to.

You keep every right you already had in your photograph. You give us permission to use it for the single purpose of creating, producing and delivering your order, and nothing else.

We will not use your photograph or your finished portrait in advertising, on social media, or anywhere public without asking you first and getting a yes.

If a photograph turns out to be unusable, we will tell you and ask for another. If you would rather not send one, we refund you in full.

Your proof, and what approving it means

Nothing is printed until you have seen it. We email you a watermarked proof, normally within 12 hours, and you can view it in your order portal.

From there you can do one of three things:

  • Approve it we send it to print that day and the order becomes final.
  • Ask for a change tell us what to alter and we will send a new version, normally within 12 hours. One revision is included.
  • Cancel at any point before you approve, for a full refund.

If we do not hear from you within 48 hours of sending your proof, we treat it as approved and send it to print. We do this so your order still arrives on time, and we send a reminder before the deadline passes. The deadline is shown on your proof email and in your portal.

You told us you understood this when you ordered, by ticking the box on the product page. If that is not what you want, ask for a change or cancel before the 48 hours are up and nothing will be printed.

Changing your mind

Because every portrait is made to your order from your own photograph, it is a personalised item. Under regulation 28 of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, personalised goods are exempt from the usual 14-day right to change your mind.

In plain terms: before you approve your proof you can cancel for any reason and get all of your money back. After you approve it, you cannot cancel simply because you have changed your mind, because by then we have printed something that is of no use to anyone else.

This does not affect anything in the next clause. If what arrives is faulty, damaged or not what was described, you are covered regardless of approval.

If something is wrong

Your rights under the Consumer Rights Act 2015 apply in full and always will. What you receive must be of satisfactory quality, fit for purpose, and as described.

  • Damaged in transit send us a photograph and we replace it. No forms, no argument.
  • A fault in the printing or framing same, we replace it.
  • Not what you approved if what arrives does not match the proof you said yes to, we put it right.

Tell us within 30 days of delivery and you can ask for a refund, a replacement, or a repair. After 30 days we will still repair or replace a faulty item.

We do not ask you to return a damaged portrait. Sending a broken frame back through the post helps nobody.

Delivery

We deliver to addresses in the United Kingdom. Printing and framing takes two to three working days from your approval, and delivery a further three to four.

Those are honest estimates rather than guarantees, and they run from the moment you approve your proof, not from when you ordered. A portrait approved quickly arrives sooner.

Where we advertise a cut-off date for delivery before a particular occasion, that date assumes you approve your proof promptly. If you approve after the cut-off we will still make your portrait, but we cannot promise it will arrive in time.

Risk passes to you when the parcel is delivered to the address you gave us. Please check the address at checkout, because we cannot redirect a parcel once it has left the printer.

Price and payment

Prices are in pounds sterling. We are not VAT registered, so no VAT is charged and none is shown separately. Delivery is shown at checkout before you pay.

Payment is taken in full at checkout, through Shopify. We never see or store your card details.

If a price is obviously wrong and you could reasonably have realised it, we do not have to sell at that price. We will tell you and either refund you or ask if you want to go ahead at the right price.

What you can do with your portrait

We own the copyright in the artwork we create. You get a licence to use it for personal purposes for as long as you like, which covers everything most people want to do with it.

  • Yes hang it, reprint it for yourself, use it as a wallpaper, send it to family, post it on your own social media.
  • Ask us first selling it, printing it on products for sale, or using it to advertise a business.

Where your order includes a digital copy, we send it after you approve your proof, as a download link that stays live for 30 days. Save the file somewhere safe rather than relying on the email.

Our responsibility to you

If we fail to meet these terms, we are responsible for loss you suffer that is a foreseeable result of that failure. We are not responsible for losses that were not foreseeable.

We do not limit our liability in any way for death or personal injury caused by our negligence, for fraud, or for anything else the law does not permit us to limit. Other than that, our liability for any order is limited to what you paid for it.

We supply to consumers for domestic and private use. If you buy for a business purpose, we are not liable for lost profit, lost business or lost opportunity.

Your personal information

We are the data controller for the information you give us. We use it to make and deliver your order, to keep you updated about it, and to keep proper business records.

Your photograph is stored privately and is never publicly accessible. We keep it while your order is live and for a reasonable period afterwards in case you reorder or something needs putting right.

You can ask us what we hold, ask us to correct it, or ask us to delete it. Email hello@likenesseditions.co.uk and we will deal with it. Our privacy policy explains this in full.

Complaints

If something has gone wrong, email hello@likenesseditions.co.uk with your order number. We aim to reply within one working day and to resolve things without either of us needing anyone else involved.

If we cannot agree, you are free to take the matter further. Nothing here stops you exercising your legal rights or making a complaint to a relevant body.

General

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland you may bring proceedings in your own courts.

If a court finds any part of these terms unenforceable, the rest continues to apply.

If we do not insist on something immediately, that does not mean we have given up the right to insist on it later.

This contract is between you and us. Nobody else has any right to enforce it.
